The preliminary title report, or "prelim," is a document the title company issues early in escrow. It shows the current state of the property's title and what the title policy will and won't cover.
It lists the legal owner, the legal description, and any liens, loans, easements, or restrictions currently recorded against the property.
The prelim is your chance to spot title issues before you commit. Reviewing it is part of your due diligence during the contingency period.
Look for unexpected liens, easements that affect how you can use the property, or CC&Rs in an HOA community that come with rules and obligations.
Most items, like the seller's existing loan, are cleared through escrow at closing. Others may need to be resolved or negotiated first.
